1. Acceptance of Terms

By accessing or using NailTheTest (“the Service”), operated by NailTheTest LLC (“we,” “us,” “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

NailTheTest is an exam preparation platform that helps you study, practice, and build confidence for high-stakes tests. Our proprietary learning engine continuously analyzes your performance, identifying where you need help and where you are strong, to focus your study time on what matters most. We grade your readiness and tell you when you are prepared.

For captain's license students, NailTheTest covers all four exam sections with 800+ practice questions, structured lessons, spaced repetition, and chart work feedback. For precalculus students, we offer chapter-by-chapter practice with an intelligent tutor available 24/7.

Educational content, not official exam preparation. NailTheTest is an independent educational platform. Our content is developed independently using publicly available regulations, standards, and educational best practices. We are not endorsed by, affiliated with, or sponsored by any government agency, testing authority, or educational institution. There is no guarantee that using the Service will result in passing any exam. Results depend on your effort, preparation, and the specific test administered.

3. Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity under your account. Each account is for a single individual. Account sharing is not permitted. You must be at least 13 years old to create an account. Parents or guardians may create accounts on behalf of minors.

4. Purchases and Access

• Math plans are one-time purchases granting access for the specified period (semester or full year).
• Captain's License plans are one-time purchases granting 12 months of full access from the date of purchase.
• All payments are processed securely by Stripe. We do not store your credit card information.
• Access is tied to your individual account and is non-transferable.
• 30-day satisfaction guarantee. If you are not satisfied with your purchase, you may request a full refund within 30 days of the purchase date by contacting info@nailthetest.com. After 30 days, purchases are non-refundable.

5. Free Trials

We may offer free trial periods. Trial eligibility is limited to one per person. At the end of the trial, you may purchase a plan to continue with full access.

6. Intellectual Property

All content on NailTheTest, including questions, explanations, lessons, code, design, and AI-generated outputs, is the property of NailTheTest LLC or its licensors. You may not copy, distribute, sell, or create derivative works from our content without written permission.

Public domain materials (COLREGS text, CFR excerpts, USCG forms) remain in the public domain.

7. Acceptable Use

You agree not to:

• Share your account credentials with others or allow others to use your account
• Scrape, copy, or redistribute our question bank or content
• Use automated tools to access the Service
• Attempt to reverse-engineer our platform features
• Use the Service for any unlawful purpose

8. Learning Engine, AI Tutoring & Study Analytics

Our proprietary learning engine, tutor, chart checker, and study plan features use advanced technology, including AI services provided by Anthropic Claude, to personalize your experience. These outputs are educational aids and may occasionally contain errors. Always verify critical information against official publications and regulations.

AI tutoring is supplemental. The AI tutor is a study aid, not a replacement for classroom instruction, professional training, or hands-on experience. AI-generated explanations, feedback, and study recommendations may contain inaccuracies. Do not rely on AI tutor responses as authoritative sources for exam content.

Progress data and study analytics. The Service tracks your study sessions, question performance, section mastery, time spent, and readiness scores to provide personalized study recommendations. This data is associated with your account and is used solely to improve your learning experience. You may request deletion of your progress data by contacting techsupport@nailthetest.com. Parent accounts linked to student accounts may view the student's progress data.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee that you will pass any exam. Results depend on your effort, preparation, and the specific test administered. If you do not pass and your access period has expired, contact us and we will extend your access at no additional charge. See our Disclaimer for details.

10. Limitation of Liability

To the maximum extent permitted by law, NailTheTest LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Modifications

We may update these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of Texas. Any disputes shall be resolved in the courts of Texas.
